Toki Live - Terms of Service
These terms of service ('Terms') apply to any user ('User' or 'You') using the current and future versions of the video communication service ('TOKI') owned and provided by Mojab Innovation for Information Technology (the 'Company', 'We' or 'Us'). PLEASE CAREFULLY READ THESE TERMS BEFORE USING OUR SERVICE. TERMS APPLY TO ALL USERS WHO USE THE SERVICE AS REGISTERED OR NON-REGISTERED. BY ACCESSING AND USING TOKI, YOU AGREE TO BE BOUND BY THE TERMS SET FORTH HEREIN, THE AMENDED TERMS PURSUANT TO THE TERMS, AND THE USER GUIDELINES ESTABLISHED PURSUANT TO THESE TERMS. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE IMMEDIATELY TERMINATE YOUR USE OF TOKI.
The Supplementary Terms, which can be found at the end of the Terms, may apply in addition to the Terms respectively to Users having residence in certain countries.
CHAPTER 1. General Provisions
1. Purpose
The purpose of these Terms is to set forth the respective rights, obligations, and responsibilities of the Company and You with regard to Your use of TOKI on Your personal computer or mobile device (collectively, “Device”), either by downloading the service application (the “TOKI APP”) from Google Play Store or Apple App Store (“Application Store(s)”) or by accessing the service website (“TOKI Web”) provided by the Company. These Terms govern the legal relationship between You and the Company, and Your relationship with the Application Stores is subject to the respective terms and conditions of the Application Stores.
2. Changes to these Terms
The Company reserves the right to modify these Terms as necessary, provided such modifications comply with relevant laws and regulations. In the event of any changes to these Terms, the Company will notify Users with details of, reasons for, and the effective date of the change at least seven (7) days prior. If the changes are unfavorable to Users, a 30-day notice will be given. Continued use of TOKI after the effective date constitutes Your acceptance of the change.
3. Additional Terms
Any matters not stipulated in these Terms shall be governed by relevant laws and regulations, the Company’s individual Terms of Service, and any operation policies and rules set by the Company.
4. Notification and Communication
The Company may notify Users of important updates or changes by posting them on the platform, using the contact information provided by Users, or other appropriate methods. Users must update their contact details if there are any changes. The Company will not be liable for any disadvantages arising from failure to do so.
CHAPTER 2. Ownership and Licenses Regarding TOKI
1. Ownership of TOKI Contents
Unless otherwise stipulated, all intellectual property, including text, graphics, images, videos, and other content provided on TOKI (collectively, “Company Assets”), is owned solely by the Company and is protected by copyright laws and international intellectual property treaties. Any new releases, modifications, or enhancements to the Company Assets also belong solely to the Company.
2. Scope of License Regarding TOKI
The Company grants You a personal, limited, non-commercial, non-exclusive, non-assignable, revocable license to download, install, and use the TOKI APP on Your Device for personal use. No rights to the source code of the TOKI APP are granted. Any usage that exceeds the scope of the license may result in revocation.
3. Scope of License Regarding Your Information
By downloading the TOKI APP, You grant the Company the right to access, collect, and use data from Your address book and contact list in accordance with relevant laws and the Company’s Privacy Policy. **You will be explicitly asked for consent to access any personal data during registration or before using specific features of the service.**
4. Content License
By uploading or sharing content on TOKI, You grant the Company and its affiliates a worldwide, royalty-free, non-exclusive, sublicensable license to use, host, modify, and distribute Your content as necessary for the operation and promotion of the platform.
CHAPTER 3. Commencement of Use of Service
1. Consent to the Terms
You agree to be bound by these Terms, the amended terms, and the User guidelines upon using TOKI, whether as a registered or non-registered User. If You do not agree, please discontinue use immediately.
2. Membership Registration Process
Users can register for membership using their phone numbers. **When registering, You will be required to provide explicit consent to the collection and processing of Your personal data, in line with GDPR.** Inaccurate information or attempts to register using another person’s identity may result in suspension of service or deletion of accounts. Users under 17 years old are prohibited from using TOKI.
3. Eligibility
TOKI is intended for Users aged 17 and above. By using the service, You affirm that You are competent to comply with these Terms.
CHAPTER 4. Rights and Obligations of the Company and Users
1. Obligations
Users must use TOKI in compliance with these Terms, Community Guidelines, and any other applicable user guidelines. The Company reserves the right to suspend service if these obligations are not met.
2. Prohibited Acts
Users are prohibited from engaging in illegal or inappropriate activities such as: - Using the platform for illegal purposes or to harm others. - Transmitting malicious code or engaging in activities that disrupt the platform. - Engaging in unauthorized commercial activities, spamming, or fraudulent behavior. - Infringing on the intellectual property rights of the Company or third parties.
3. Prevention of Unauthorized Use
The Company reserves the right to use technological barriers to prevent unauthorized or illegal use of TOKI.
CHAPTER 5. Content Moderation and User Safety
1. AI-Based Content Moderation
TOKI employs **AI-based content moderation** to block and filter objectionable content, including offensive and nudity-related material. This system operates in real-time to ensure a safe and respectful environment for all Users.
2. User Agreement on Content Moderation
By using TOKI, You agree to the End User License Agreement (EULA) and these Terms, which clearly state that there is **no tolerance** for objectionable content, including but not limited to offensive, abusive, or explicit material.
3. Objectionable Content Filtering
All live and uploaded content is subject to automated filtering for objectionable material. Content flagged by the AI system will be removed immediately.
4. User Flagging System
Users can flag any content they deem offensive or inappropriate. Flagged content will trigger a review by the Company’s moderation team.
5. Blocking Abusive Users
Users can block any user they believe to be abusive or inappropriate. Once blocked, the abusive user will no longer be able to communicate or interact with the blocking user.
6. Response to Objectionable Content
The Company will respond to reports of objectionable content within **24 hours**. Content that violates these Terms will be removed, and the offending user may be permanently banned from the platform.
CHAPTER 6. Data Protection and Privacy (GDPR Compliance)
1. User Rights
In compliance with GDPR, You have the following rights regarding Your personal data: - **Right of Access**: You may request to view the personal data we hold about You. - **Right to Rectification**: You may request corrections to any inaccurate or incomplete data. - **Right to Erasure (Right to be Forgotten)**: You may request the deletion of Your data at any time. - **Right to Data Portability**: You may request a copy of Your data in a commonly used, machine-readable format to transfer to another service provider. - **Right to Restrict Processing**: You may request to limit the use of Your personal data under certain circumstances. 2. Data Retention
We will retain Your personal data for as long as Your account is active or as needed to provide You services. Data will be deleted upon account closure, or as required by law.
3. Consent to Data Collection

4. Data Breach Notification
In the event of a data breach, You will be notified within **72 hours** in compliance with GDPR.

CHAPTER 7. Termination of Service
1. Termination by User
You may terminate Your use of TOKI by deleting Your account. Subscription services must be canceled before deleting the account. **Deleting Your account will include deletion of all personal data in compliance with the Right to Erasure under GDPR**.
2. Termination by the Company
The Company may suspend or terminate Your account if You engage in prohibited activities or violate these Terms, or fail to maintain accurate account information.
CHAPTER 8. In-App Purchases and Subscriptions (Apple App Store Compliance)
1. In-App Purchases
All in-app purchases, including virtual currency and other items, must be made through the Apple App Store or Google Play Store in-app purchase systems. Refund policies are governed by the respective stores.
2. Subscription Services
Subscription services are automatically renewed unless canceled 24 hours before the current subscription period ends. **To cancel a subscription**, follow the instructions provided by the app store.
3. Account Deletion
In accordance with Apple App Store guidelines, users can delete their TOKI account and associated personal data directly from within the app. This option is available in the **Settings** menu.
CHAPTER 9. Indemnification and Disclaimer of Warranties
1. Indemnification
You agree to indemnify the Company for any claims or damages arising from Your use of the service or Your violation of these Terms.
2. Disclaimer of Warranties
The TOKI service is provided "as is" without any warranties of any kind, express or implied. The Company does not guarantee the continuous availability of the service or that it will be free from errors.
3. Limitation of Liability
The Company will not be liable for any indirect, consequential damages arising from Your use of TOKI.
CHAPTER 10. Governing Law and Jurisdiction
1. Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms are subject to the exclusive jurisdiction of the Ministry of Justice.
